Commissioner Miller Gives 2012 Kentucky Tax Amnesty Report

Commissioner Thomas B. Miller was speaker at the Florence Rotary Club the week October 29th.  Commissioner Miller made it clear that the clock is ticking if you qualify and are interested in applying for Tax Amnesty.  Those who have outstanding tax liability for the Periods Ending after 12/31/01 but prior to 10/1/2011 are eligible to apply.  The application period is October 1 – November 30, 2012 if you wish to apply.  Of importance: should you receive a letter from the state referring to Tax Amnesty and you do not believe that you owe taxes simply contact the number provided in the letter for help.   The information below is provided by the State of Kentucky Department of Revenue and gives you a complete and comprehensive overview of the Tax Amnesty Statute.

2012 Kentucky Tax Amnesty

Amnesty Application Period: October 1 – November 30, 2012
Statute: KRS 131.400 – KRS 131.445
Tax Amnesty is a limited-time opportunity for taxpayers to pay back taxes without penalties or fees and only half of the interest due.  Taxpayers must file and pay in full all eligible and non-eligible tax periods.   Corporate officers must include all assessed corporate liability and applicable individual liability with their application.
Taxpayers Eligible for Amnesty
  • Those with an amnesty-eligible outstanding liability – Periods Ending after 12/31/01 but prior to 10/1/2011
  • Those with an amnesty-eligible non-filed returns
  • Those amending an amnesty-eligible filed returns
  • Those with amnesty-eligible omitted personal/public service property taxes
Eligible Taxes Taxes administered by the Department of Revenue with the following exceptions:

  • Locally collected real property taxes
  • Motor vehicle/motorboat property tax, collected by the county clerk
  • Tangible/Intangible property taxes, payable to local officials
Not  Eligible for Amnesty
  • Tax liabilities related to a criminal investigation
  • Penalties imposed under KRS 131.630 or 138.205
Filing for Tax Amnesty
  • Prefilled amnesty applications will be sent to taxpayers with outstanding tax liabilities.
  • Taxpayers who do not receive a pre-filled application may obtain an application through the Department of Revenue or on the Tax Amnesty website
What to submit with the Amnesty Application
  • The Tax Amnesty Certification Sheet
  • Any amnesty reports that have been altered
  • Application Supplemental Schedules
  • Applicable returns
  • Payment in full
If you cannot pay in full
  • Payment agreements may be considered based on financial need
  • Final payment must be made by May 30, 2012
  • Full interest will be paid, instead of ½ interest from October 1, 2013 until the end of the term
